The Third Amendment to the Constitution, states "No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law." The amendment is considered an 18th Century curiosity that does not usually find it being invoked in modern court cases. One previous case, Engblom v. Carey, involved the quartering of National Guard troops in prison housing for guards during a correctional officers' strike in 1979. Now we have a case involving Antony Mitchell, his parents Michael and Linda Mitchell, and the Henderson, Nevada Police.
